Child Support Modification
When a soon-to-be divorced couple reaches a child custody arrangement or has the court decide the issue, the next step is determining child support payments. Usually, the non-custodial parent is required to pay a monthly sum to the custodial parent to help with the costs of raising the child or children.
You may be able to modify the amount of support you pay or receive in some cases. If you have experienced a change in circumstances and need to modify your child support arrangement, contact the Fort Lauderdale child support lawyers of Eric N. Klein & Associates, P.A., at 954-580-8080 today for a free consultation.
Requesting a Modification
In order for a child support modification to take place, an individual will need to petition the court that originally set the amount of the support. Before doing this, though, individuals should make sure that there has been a substantial change in circumstances that warrants a modification.
Though there are no set guidelines to determine what is substantial and what is not, a court may be more likely to grant a modification when:
- The payer loses a job or a substantial amount of income
- The payee experiences a substantial increase in income
- The payee remarries
It is important to note that since modification is up to the discretion of the court, there is no precise way to tell beforehand whether a modification will be granted.
